Part B — Terms and Conditions
1. About Rootlight Lab
Rootlight Lab (rootlightlab.com) is an educational podcast production platform operated by the entity identified in Part A above. We create structured podcast series and companion learning materials designed for curious minds who value depth, clarity, and well-grounded knowledge.
These Terms and Conditions ("Terms") govern the relationship between Rootlight Lab and any person who visits, registers on, or purchases products through our website. By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
2. Eligibility and Account Requirements
In order to use our website and/or purchase our products, you must:

Be at least 16 years of age. In France, the minimum age for digital consent under Article 8 of the GDPR is 16 years. Users under 16 may only use the platform with the verified consent of a parent or legal guardian.

Possess the legal capacity to enter into a binding agreement under the laws of your country of residence.

Not be located in a country subject to embargo or international sanctions applicable under French or EU law.
By using our services, you represent and warrant that you meet all of the above conditions. Rootlight Lab reserves the right to request verification and to suspend access if eligibility cannot be confirmed.
3. Our Products and Services
Rootlight Lab currently offers the following two access levels:
3.1 Seed — Free Access
Seed is our free tier. It grants registered users access to:

All published podcast episodes on the Rootlight Lab website and hosting platform (Buzzsprout).

A selection of educational blog posts published on rootlightlab.com.

Our newsletter and series update communications.
Seed access requires registration with a valid email address. It does not require payment. Rootlight Lab reserves the right to modify the content available under the Seed tier at any time.
3.2 Branch — Companion Learning Pack
Branch is a one-time paid purchase available per series at a price of €12.00 TTC (toutes taxes comprises, inclusive of applicable VAT). It grants the purchasing user personal, non-transferable access to:

Companion learning materials including episode notes and full transcripts for the purchased series.

Knowledge-check questions and a series companion guide.
-
Bonus episodes and companion blog posts specific to the series.
-
Access to the Lumen AI learning companion for that series.
Each Branch purchase covers a single series. A separate purchase is required to access companion materials for additional series. The price of €12.00 TTC includes all applicable taxes. Rootlight Lab reserves the right to modify Branch pricing for future series with prior notice published on the website.
4. Purchasing — Commercial Terms
4.1 Placing an Order
When you purchase a Branch pack, you confirm that you have read the full description of the series and its companion materials before completing your purchase. By completing the checkout process, you enter into a legally binding purchase agreement with Rootlight Lab governed by these Terms and French consumer law.
4.2 Pricing and VAT
All prices displayed on rootlightlab.com are stated in euros (€) and are inclusive of all applicable taxes (TTC — Toutes Taxes Comprises), in accordance with Article L.112-1 of the French Code de la consommation. The applicable VAT rate is indicated at checkout. Rootlight Lab reserves the right to correct any pricing errors at any time prior to order confirmation.
4.3 Payment Processing
All payments are processed securely through Wix Payments or an equivalent third-party payment provider. Rootlight Lab does not store credit or debit card details on its own servers. By providing payment details, you authorise the processing of the applicable charge. Payments are due in full at the time of purchase.
5. Right of Withdrawal — Droit de Rétractation
French Consumer Law — Article L.221-28 Code de la consommation
Under French law, consumers have a 14-day right of withdrawal on distance contracts. For digital content not delivered on a physical medium, this right is forfeited once the consumer has given explicit consent to immediate delivery and acknowledged the loss of the right of withdrawal. The mechanism below satisfies this legal requirement.
In accordance with Articles L.221-18 and L.221-28 of the French Code de la consommation, you have the right to withdraw from any purchase made on rootlightlab.com within fourteen (14) calendar days of the date of your order, without giving any reason.
However, if you wish to access your Branch companion materials immediately upon purchase — before the 14-day withdrawal period has expired — you must expressly consent to the following at checkout:

I acknowledge and expressly agree that, by doing so, I waive my right of
withdrawal in accordance with Article L.221-28 of the French Code de la
consommation. I understand that this purchase will be non-refundable once
content access has been granted."
If you do not check this box at checkout, your right of withdrawal remains active for 14 days. To exercise your right of withdrawal, contact us at hello@rootlightlab.com within 14 days of your purchase date, clearly stating your intention to withdraw. A full refund will be processed within 14 days of receiving your withdrawal request, using the same payment method as your original purchase.
The right of withdrawal does not apply to the Seed tier, as it is free of charge.
6. Intellectual Property
All content made available through Rootlight Lab — including but not limited to podcast episodes, audio files, scripts, companion guides, quiz materials, blog posts, visual assets, the Lumen AI companion interface, and all associated branding — is the exclusive intellectual property of Rootlight Lab and its operator, protected under French and international copyright law.
Purchasing a Branch pack or registering for Seed access grants you a personal, non-exclusive, non-transferable licence for individual, non-commercial learning use only. This licence does not grant you any ownership rights in the content.
You may not, without prior written authorisation from Rootlight Lab:

Reproduce, copy, distribute, or publicly share any content, in whole or in part, through any medium.

Upload, resell, sublicense, or incorporate our content into your own courses, publications, or products.
-
Systematically download or scrape our content using automated tools.
-
Remove or alter any copyright notices or attributions.
Any unauthorised use may result in immediate suspension of your access and legal action under applicable law.
7. Acceptable Use
By using rootlightlab.com, you agree to use the platform solely for lawful, personal, non-commercial learning purposes. You must not:

Attempt to interfere with, disrupt, or gain unauthorised access to the platform or its underlying systems.

Use the platform to distribute spam, malware, or any harmful or unlawful content.

Misrepresent your identity or your affiliation with Rootlight Lab.
-
Circumvent any technical measures used to protect access to paid content.
-
Use the Lumen AI companion for any purpose other than personal learning in connection with Rootlight Lab series.
8. Right to Modify the Offering
Rootlight Lab reserves the right to modify, suspend, or discontinue any feature, product, or service at any time, with or without prior notice, subject to the rights of users who have already completed a valid purchase. In particular:

The content available under the Seed tier may be updated, expanded, or reduced at any time.

New series may be added, and existing series may be updated, corrected, or retired.

Rootlight Lab may introduce new products or access tiers in the future.
Material changes that affect paying Branch users will be communicated by email at least 30 days in advance where reasonably practicable.
9. Account Suspension and Termination
Rootlight Lab reserves the right to suspend or permanently terminate your access to the platform, with or without prior notice, in any of the following circumstances:

You have violated any provision of these Terms.

You have used the platform in a manner that is unlawful, abusive, or harmful to Rootlight Lab or other users.

You have provided false information during registration or at checkout.

Rootlight Lab is required to do so by applicable law or a competent authority.
You may request cancellation of your account at any time by contacting hello@rootlightlab.com. Cancellation of your account does not entitle you to a refund for any Branch purchases already made, except as provided under Section 5 above. Access to previously purchased Branch materials will cease upon account termination.
10. Warranties and Responsibility for Content
Rootlight Lab warrants that:

Branch companion materials will be made available for access promptly following a confirmed purchase.

We will use reasonable efforts to ensure the accuracy and quality of all content at the time of publication.

In the event of a technical failure preventing access to purchased content, we will take reasonable steps to restore access or provide an alternative remedy within a reasonable timeframe.
Rootlight Lab does not warrant that the platform will be available uninterrupted or error-free at all times. Scheduled maintenance and unforeseen technical issues may cause temporary interruptions. We will communicate planned downtime where reasonably possible.
11. Limitation of Liability
To the maximum extent permitted by applicable French law, Rootlight Lab shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform or its content, including loss of data, loss of earnings, or loss of business opportunity.
Nothing in these Terms excludes or limits Rootlight Lab's liability for:

Death or personal injury caused by our negligence (faute lourde ou faute intentionnelle).

Fraud or fraudulent misrepresentation.

Any liability that cannot be excluded or limited under French consumer law, including statutory guarantees under Articles L.217-1 et seq. and L.224-25 et seq. of the Code de la consommation applicable to digital content.
Where liability cannot be excluded, the total aggregate liability of Rootlight Lab to any individual user shall not exceed the amount paid by that user for the product or service giving rise to the claim in the twelve months preceding the event.
12. Indemnification
You agree to defend, indemnify, and hold harmless Rootlight Lab, its operator, and any associated contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your violation of any provision of these Terms.

Your infringement of any third-party intellectual property, privacy, or other rights in connection with your use of the platform.

Any unlawful or abusive use of the platform attributable to your account.
13. Right to Modify These Terms
Rootlight Lab reserves the right to modify these Terms at any time at its sole discretion. When material changes are made, we will notify registered users by email and publish the updated Terms on this page with a revised effective date. Your continued use of the platform after the effective date of any modification constitutes your acceptance of the updated Terms.
If you do not agree to any updated version of these Terms, you must stop using the platform and may request account deletion by contacting hello@rootlightlab.com.
14. Promotional Communications
By registering for Seed access, you consent to receive our newsletter and educational series updates by email. You may withdraw this consent at any time by clicking the unsubscribe link in any email we send, or by contacting hello@rootlightlab.com.
We will not send promotional communications to Branch purchasers beyond those directly related to their purchase and any series updates, unless they have separately consented to our newsletter.
Rootlight Lab complies with the French rules on commercial electronic communications under Articles L.34-5 of the French Code des postes et des communications électroniques.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
15.2 Jurisdiction
Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of France, subject to the mandatory consumer protection provisions applicable in the user's country of residence where required by EU law.
15.3 Consumer Mediation — Médiation de la Consommation
Mandatory under French law — Ordonnance n°2015-1033 du 20 août 2015
French businesses are required by law to provide consumers with access to a certified consumer mediator for unresolved disputes. The details below must be completed before publication.
In the event of a dispute that cannot be resolved directly with Rootlight Lab within 30 days of a written complaint, you have the right to refer the matter free of charge to an approved consumer mediator (médiateur de la consommation) in accordance with Articles L.616-1 and R.616-1 of the French Code de la consommation.

Rootlight Lab is committed to protecting your personal data. This Privacy Policy explains what data we collect, how we use it, and what rights you have. It applies to all users of rootlightlab.com and is drafted in compliance with Regulation (EU) 2016/679 (GDPR) and French data protection law as enforced by the CNIL (Commission Nationale de l'Informatique et des Libertés).

17. What Data We Collect and Why
17.1 Data You Provide Directly

Email address — collected when you register for Seed access or purchase a Branch pack. Used to deliver content, send transactional communications, and, if consented, our newsletter.

Payment data — processed at checkout through Wix Payments or equivalent. Rootlight Lab does not store card or bank details on its own servers.

Basic usage analytics (page visits, content interactions, browser type, approximate location) — collected through Wix's built-in analytics tools. Used to improve the platform and understand how content is used. No individual profiling is conducted.

17.3 Data Processed via Lumen AI
Lumen is the AI-powered learning companion available to Branch tier members. When you interact with Lumen, your queries and inputs are processed by the Google Gemini API in order to generate contextually relevant learning responses. Your interactions are not stored by Rootlight Lab for commercial purposes. Processing is subject to Google's data processing terms and privacy policy (policies.google.com/privacy).
18. Legal Bases for Processing
We process your personal data on the following legal bases under Article 6 GDPR:

Contract performance (Art. 6(1)(b)) — processing your order, delivering purchased content, managing your account.

Legitimate interests (Art. 6(1)(f)) — basic analytics to improve the platform, security monitoring.

22. Data Retention
We retain your personal data only for as long as necessary for the purposes described in this policy, or as required by applicable law:

26. Health-Adjacent Content
Some Rootlight Lab series cover topics related to health, neurodevelopment, psychology, and behaviour — including the ADHD Toolkit for Parents series. This content is designed to help listeners understand published research, evidence-based frameworks, and general educational perspectives. It is not a clinical assessment, diagnosis, treatment plan, therapeutic intervention, or medical recommendation of any kind.
If you or someone in your care has health-related concerns, we encourage you to consult a qualified healthcare provider. The hosts, producers, and contributors involved in Rootlight Lab series do not act in any clinical or therapeutic capacity.
27. Our Use of Artificial Intelligence
Rootlight Lab is transparent about the role of artificial intelligence in our production process. We use AI tools — primarily the Google Gemini API — to assist with research synthesis, script drafting, content structuring, quiz generation, and the Lumen learning companion.
All AI-assisted content is reviewed and refined by Xavier Canadell, a senior instructional designer with more than 20 years of professional experience working with organizations including the World Bank, UNICEF, and the World Health Organization. AI is a production tool within our workflow — professional instructional design expertise and editorial judgment guide the accuracy, structure, and quality of every series.
Despite careful review, AI-assisted content may occasionally contain errors, limitations, or outdated information. We are committed to promptly correcting any factual inaccuracies. If you identify content that you believe is inaccurate or misleading, please contact us at rootlightlab@gmail.com.
28. Sources and Attribution
We reference published research, named theoretical frameworks, and attributed sources throughout our content. We aim to represent sources accurately and to attribute ideas, findings, and models to their correct origins. If you believe a source has been misrepresented or insufficiently attributed, please contact us so that we can review and correct it.
